In Imperial, if someone is arrested, he or she will be taken to jail and booked. The person will then need to stay in jail until the date of the trial for the crime that he or she has been accused of committing. Sometimes, trials take multiple days. However, there are circumstances in which an individual will have the opportunity to get out of jail on bail.
When a defendant has the chance to get out of jail on bail, the arresting officers and the courts are basically saying that they will let the defendant walk free until the commitment to the courts has been fulfilled. In exchange for the freedom, the defendant will need to give the courts an amount of money to hold onto. That amount of money is the bail. Bail is determined based on the crime that was supposedly committed.
The bail rate is the same for all counties across the state of California. The major difference in bail has to do with the different bail rates that are charged for different crimes.
When a person is unable to pay the full amount of the bail on his own or her own, the person may elect to use the services of a bail bonding agency. The agency will provide the defendant with the full amount of the bail in exchange for a down payment. Most agencies charge ten percent of the total cost of the bail as a down payment.
The defendant will also need to supply the bail bonding agency with collateral that it can hold onto until the defendant has fulfilled the full obligation to the courts. Once that full obligation has been fulfilled, the bail bonding agency will release the collateral. The agency will also receive a refund for the bail bond that it provided the courts.
However, if the defendant fails to appear in the court, the bail bonding agency will not receive a refund and the defendant will lose collateral. The agency may also track the defendant down to return him or her to court to stand trial.
