In Marin, if a person is arrested and taken to jail, the person may be given the opportunity to get out of jail on bail while she or he awaits trial for the crime that he or she has been accused of committing. Bail is an amount of money that is associated with a particular crime. The bail amount for a crime will vary by crime, but it will be the same for all counties across California.

When a person is given the opportunity to pay bail in order to get out of jail, the courts are basically requiring that the defendant provide money for the courts to hold onto. The courts will refund this money if the defendant fulfills the full legal obligation by attending all trials and so forth. However, if the defendant fails to fulfill a full legal obligation to the courts, the courts will keep the bail bond.

Many defendants use a bail bonding agency to help pay for the cost of getting out of jail on bail. The bail bonding agency will provide the defendant with the full amount of money that is needed to get out of jail on bail. This amount of money will be refunded to the bail bonding agency if the defendant fulfills the legal obligation to the courts. Thus, the bail bonding agencies have a vested interest in making sure that the defendant show up in court.

The defendant will pay the bail bonding agency a fee for its services. This fee is generally about ten percent of the cost of the bail bond. The bail bonding agency may also require the defendant to put up collateral as an additional assurance that he or she will fulfill a legal obligation. When the defendant fulfills the full legal obligation, the collateral may be released back to the defendant.

However, if the defendant fails to fulfill a legal obligation, not only will the courts hold onto the bail bonding agency’s money, but the agency will seize the collateral from the defendant to make up for the lost bail bond money. The bondsman may also track the defendant down with a bounty hunter, rearrest the defendant and return him to jail or to court.
