San Benito County Bail Bonds

In San Benito, when a person is arrested for a health and safety code violation, penal code violation, vehicular violation or any other sort of violation, the person will be taken to jail for booking. The person will then have to wait in jail until his or her trial for the crime that he or she has been accused of committing unless the courts allow the defendant to leave jail.

One of the ways that a defendant can get out of jail is by paying bail. Bail is an option that is given to some defendants. When a defendant is given the option to pay bail, the defendant is asked to provide a monetary assurance that he or she will return to court to fulfill a legal obligation. Thus, the courts require that the defendant supply the courts with a bond for the amount of the bail. When a defendant fulfills the legal obligation, the courts will return to bail bond amount to its payee.
Because many defendants do not have enough cash to pay bail on their own, they turn to bail bonding agencies for financial assistance. The role of the bail bonding agency is to supply the courts with the full amount of the bail bond in exchange for the release of the defendant from jail. Most bail bonding agencies charge about ten percent of the total cost of the bail for their services. In addition, the defendant will need to use his or her assets as collateral to ensure the bail bonding agency that he or she will fulfill a legal obligation. When the defendant fulfills the legal obligation, the bail bonding agency will receive a full refund of the bail bond amount.

However, if the defendant does not fulfill the legal obligation, then the bail bonding agency will not receive a refund of the bail amount that it had put up for the defendant. In such a case, the bail bonding agency may seize the defendant’s assets to help cover the cost of the lost bail. Also, the bail bonding agency may hire a bounty hunter to track the defendant down. A bounty hunter may legally arrest the defendant and return him or her to jail or court. The U.S. is the only country in the world that still allows legal bounty hunting.
