San Joaquin County Bail Bonds

When a person is arrested in San Joaquin, the person will be taken directly to jail for booking. In many cases, the person will be held for a short period of time and then offered the opportunity to be released from jail on bond. If a person is given that opportunity, then the courts are essentially saying that they are letting the person go on bail in exchange for a monetary promise that he or she will return to court to fulfill a legal obligation. If the defendant fulfills the legal obligation, then the bail amount will be refunded to the payee.

Bail is determined by a bail rate schedule that is the same across all counties in California. This schedule is reviewed by a panel of judges on an annual basis. Each difference offense has a different bail rate that is specific to that particular offense.

In order to pay the bail, many defendants use the services of a bail bonding agency. A bail bonding agency will provide the full amount of funds that are necessary for the release of the defendant. In exchange for these funds, the agency will charge the defendant a rate that is usually about ten percent of the total amount of the bail.

Also, the defendant may be required to provide assets as collateral in the event that the defendant fails to appear in court or fails to fulfill a legal obligation to the courts. However, as long as a defendant fulfills the legal obligation, the bail bonding agency will receive a refund of the bail bond amount.

If the defendant fails to fulfill a legal obligation to the courts, the bail bonding agency will not receive a refund of the bail amount. In many cases, the agency will receive a refund if it can track the defendant down and return him or her to the courts. Therefore, many bail bonding agencies use the services of bounty hunters to track defendants down, rearrest them, and return them to court.

The defendant may also lose his or her collateral and be charged additional fees if he or she does not show up to court to fulfill a legal obligation.
